1. GENERAL REFUND TERMS

Refund eligibility is evaluated on a case-by-case basis according to project milestones and deliverables completed. All refunds are processed within 14 business days of approval.

2. PROJECT-BASED SERVICES

For project-based engagements, refunds are calculated based on completed work milestones:

• • Pre-Development Phase: 100% refund if cancelled before development begins.
• • Active Development: Refund for work not yet completed, minus 15% administrative fee.
• • Post-Delivery: No refund for completed and delivered work. 30-day bug-fix warranty included.

3. RETAINER SERVICES

Monthly retainer services may be cancelled with 30 days written notice. Unused retainer hours are not transferable or refundable unless otherwise specified in the service agreement.

4. DIGITAL PRODUCTS

Due to the digital nature of our services, refunds for digital deliverables (designs, code, documentation) are only available if the deliverable does not meet the specifications agreed upon in the project brief.

6. EU CONSUMER RIGHTS

1. SERVICE SCOPE

swiftbuildtech provides web development, infrastructure deployment, and technical consulting services as described in individual project proposals and service agreements. Each engagement is governed by a specific scope document agreed upon by both parties.

2. PROJECT ENGAGEMENTS

All projects begin with a signed agreement outlining scope, timeline, deliverables, and payment terms. Changes to project scope require written approval and may result in adjusted pricing and timelines.

3. PAYMENT TERMS

Invoices are payable within 14 days of issuance unless otherwise specified. Late payments incur a 2% monthly interest rate in accordance with Spanish commercial law. swiftbuildtech reserves the right to pause work for invoices overdue by more than 30 days.

4. INTELLECTUAL PROPERTY

Upon full payment, all intellectual property rights for custom-developed deliverables transfer to the Client. Pre-existing code, frameworks, and tools used in development remain the property of swiftbuildtech. Open-source components are subject to their respective licenses.

5. CONFIDENTIALITY

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives termination of the service agreement for a period of 24 months.

6. LIMITATION OF LIABILITY

swiftbuildtech's total liability shall not exceed the total fees paid by the Client for the specific service giving rise to the claim. We are not liable for indirect, consequential, or incidental damages.

7. TERMINATION

Either party may terminate a service agreement with 30 days written notice. Upon termination, Client pays for all work completed up to the termination date. Completed deliverables and source code are transferred upon receipt of final payment.

8. GOVERNING LAW

These Terms are governed by Spanish law. Any disputes shall be resolved in the courts of Barcelona, España, in accordance with EU Regulation 1215/2012 on jurisdiction in civil and commercial matters.
